What do I do to sell a Luger?
Hi,
I want to sell a Luger to a friend here in Montana and am not sure exactly what I need to do. I have a C&R License and my friend does not. We both live in the same state in the same county. Do I need to have a background check done on him? Or since it is a relic do I just need to have him fill out the yellow paper. Use to be that all we needed to do was get there name, address, and license number, but as you can tell I haven't sold anything for a long time. The Luger is recorded in my FFL book. Any help would be greatly appreciated. Thanks -- Bill |

Hello Bill,
Here in TN I always transfer a pistol to a non licensed individual through a licensed dealer. That takes care of my State law! This way you would take it off your book and sign it out to the FFL dealer. The FFL dealer would do the background check and transfer it to the individual. Just a suggestion. Regards,

Here in Colorado I get the buyer's driver's license, address. I'm also supposed to look into his/her soul for evil intent. Write it all down in my bound book.

It use to be that all we had to do with a C&R was to get the buyers name, address, and drivers license number, but I haven't sold any guns for a long time and I'm not sure if that is still all I need to do yet. I guess I will call the batf and just ask them to be sure. I really do not want to go through another dealer to do this as it costs money and also gets more people involved in our business. Bill, I think each state is different, in Washington (from what I have been told), if I want to ship, then it requires FFL or C&R in or out of state. To just sell, there is no FFL needed if no shipping. Rifles or shotguns could be sent in state without FFL or C&R.
Obviously to another C&R, such as I have, I'd send you my C&R and you'd ship. Not much help, sorry, Ed

Bill, Since you are licensed, you definately need to have the buyer fill out a 4473 for your records and call it into the NIX system. Depending on your state laws, a permit from his county sheriff may also be required. Tom H.
