Default NYS Pistol Permit Recertification

Gov Cuomo's draconian SAFE act requires all NYS pistol permit holders to re-certify their permits every 5 years.

It took me an hour and a half to fill out the online form and submit it, using my new DSL connection.

The NY State Police are now charged with the re-certification process. I don't know what they'll require in addition to the form I filled out, but I'll update this thread if/when they kick my door in...

Just a horrible governor, he vetoed the "flick knife" legislation too. They need to be sued in oblivion.

A new ISP in my area, Localnet, is now offering DSL. They didn't just a few years ago. But my dial-up ISP dumped all residential customers and went all-commercial.

But it's not broadband. They piggyback on Verizon landlines. I think the best I've seen is 286kbps according to Ookla. Still better than Verizon dial-up for sure.

I did have to have a Verizon tech come out and switch me to a different service. He confirmed that I'll never see FiOS in my lifetime. In fact, he told me they stopped upgrading to copper lines - many places still have aluminum.

Price for the DSL service is about 2 1/2 times what I paid for dial-up access. But I thought I'd give it a try.

But back to the State Police taking over the pistol permits. Many of the handguns I have had to be listed on their form as 'Other' - They didn't recognize Nambu, FN, Gasser, Helwan, or Warner; and 'Lugers' are listed as DWM, Mauser or Luger. I had to 'certify' them as what was originally on my permit, which was taken from the bills of sale/receipts. Many gun dealers don't realize that 'Luger' is a generic term (like Nylon, Teflon, Kleenex, etc) and put 'Luger' down for a DWM or a Mauser. And although most of my 'Lugers' have the suffix noted, some don't. Once it's in their database it can't be changed. It's easier to change the stamp than their records.

...Or so I'm told...

Nice, most NY folks don't get concealed carry permits Rich

I am sure you don't mean that you have to fill out a form to have guns! (Ok, I lived in Hawaii and everything was required to be registered there too, and that was 1983-1986)

If you mean the snail-mail notification from the State Police, no. My gun club got the web site from a club federation meeting.

The web site has a PDF form you can fill out and mail in as well as the online form.

Congrats, Rich, on changing over to the bicycle lane of the information superhighway--rather than remaining in the ditch!

My dealer sent out an email about the re-certification nonsense. We've had registration here since 1968, IIRC, and two tiers of permit--one for owning and transporting, the next level for carrying concealed.

We have until Jan 2018 to re-certify. My dealer says he's going to wait until the last minute, then send a hard copy completed form registered mail with return receipt requested. This gesture is to ensure it is as inconvenient for the "powers that be" as they are making it for us. They are calling it "re-certification" as opposed to "renewal" for some reason.

Ironically, I just finished refreshing (every 5 yrs.) my good standing on the county level, which needed a slip from the sheriff's office saying that I'd passed (once again) the same background check I pass every time I have a pistol transferred to me. Even this wasn't necessary in the past, as permits were issued for a lifetime, unless, of course, one transgressed. At the first sign of involuntary admission as a mental health client, being the object of a domestic order of protection, or a felony, it is revoked and they come for your guns. Now, my dealer says, we can add "not filling out a re-certification form" to the list of things to make a non gun owner of oneself.

When I register a pistol, I try to ensure its description is accurate on those forms. No paperwork is required from the transferring dealer, just divulge the name and address on the form. This form's info also can be corrected any time after the registration. But I can only speak for Schuyler County, and there is plenty of variation in this respect within the state. What a cluster-****.

We have a "pistol purchase permit" system here in my state (North Carolina) which is similarly ineffective. It was brought into existence around the time New York passed it's "Sullivan Law" regulating firearms. Our system was initially conceived so that black citizens could be prohibited access to handguns, and today it costs taxpayers almost $10 million each year to run. The 100 Sheriffs (state wide) staunchly defend the program through their lobbyist in Raleigh, even though it's resulted in thousands of prohibited people and felons holding valid purchase permits. They like the program because it protects the budget for hiring a number of employees in each county.

It's actually an interesting issue. The mechanics of the system work against it's integrity.

When you want a handgun, you go to the Sheriff. Upon request, at $5 each, Sheriffs issue an unlimited number of permits which are good for five years. They perform a background check when the permits are applied for. Dealers take the permit, and do not perform another background check at the time of sale. The sheriff offices have no resources available for tracking issued permits (after all, their agencies are there to deal with crime and criminals, not law abiding citizens - right?)...

Thus, someone can get a handful of permits, become prohibited the next day, and still hold valid permits for up to 5 years. We added a poison pill to a gun law a few years ago to require a study on the number of issued permits in felon or prohibited person's hands. After a couple of man years of study effort, they found 5,255 permits in the hands of prohibited people. Here's the study:

The permits cost citizens $5 each, but the sheriff departments spend up to $75 each to process them. That extra cost runs close to $10 million every year, the bill footed by taxpayers.

So, we have a system that leaks permits into prohibited people, sheriffs that actively support it because of the value of "background checks" (including participation in Bloomberg paid advertising opposing us the last time we tried to eliminate the system) and a system that interferes with lawful acquisition of firearms.

The sick thing here is that by just relying on the FBI NICS system at time of purchase, the public would be better served...

So, New Yorkers, get ready for similar corruption in implementation of the SAFE act provisions...

What part of these ineffective infringements on the Second Amendment don't violate the constitution?

Technically, all of it except the 7-round restriction to the number loaded into a mag has so far withstood adjudication. The SAFE act initially conflicted with the laws allowing LEO's to load more, and use mags of higher than 10 capacity, but that was "fixed." https://en.wikipedia.org/wiki/NY_SAF...gal_challenges

The 5-year validity of NC's setup is indeed ridiculous if it is assessed as to effectiveness. NY's required checks--place and time of sale/trandfer, every time--would be more up-to-date as far as containing someone's disqualifying aspects. But they've also concocted the situation of background checks for ammo sales, which is at the very least a bureaucratic nightmare and a huge expense for retailers. This provision remains unimplemented. We show our permits at purchase, and at this point, and since permits are not required for long guns, I don't know how long gun ammo is handled. Also currently, purchases from out-of-state suppliers and auctions needs to be picked up to a dealer you've had them ship to, after the copy of his FFL is forwarded to them. Ignorance abounds in this area, and several auction houses have subsequently shipped directly to me, nonetheless.

The last remaining gun dealer in my 2-hour area has these on the counter, for customer information...

The local/county pistol permit clerk charged $3.00 for every permit addition/removal - any number at one time, only $3.00.

I'm sure Cuomo will want more when the State takes over.
