If you look into the ATF regulations associated with a C&R license, you'll find a requirement to comply with all state and local laws.
Thus, even with a C&R License, if your state requires a FOID to own a pistol, you must have one to purchase a pistol. In North Carolina, we must either get individual authorization permits from the local sheriff to buy handguns, or must have a NC Concealed Carry Handgun permit. In Illinois, you must have a FOID to purchase a handgun. If you live in a state with such laws, and you don't have the state or local permit, it could be grounds for ATF to reject your application. That might be the basis for asking about it on the ATF application. Marc

What the heck is a FOID? A FOID is a "Firearm Owners Identification card", all gun owners in IL must have one, for aLL types of firearms. |

It's my understanding (and GB auctions seem to bear this out) that New York State does not honor C&R licenses...

BATF information
I am not totally sure but I believe that the question you are referring to is applicable only if you are NOT a US citizen; but, you really need to read all the questions in the sections leading to any section carefully. Parts of the application do not apply to all applicants.
REPEAT: You should read the questions VERY, VERY carefully; they can be misleading. Also, read the instructions at the bottom of the entire form; if you are still unsure of a question use these links to call for help: Here is a link to a BATF directory in WV: BATF Directory This is also a useful link: BATF Useful link And, as a bonus, here is a link to a sample form that helps clarify the application: Sample Application Filled Out. I did not answer one of the questions correctly. I misinterpreted it. It has taken a month for them to let me know this and that was only after I called them repeatedly for two days. The BATF has 60 days to adjudicate an application; however, I am not sure when the clock is started. I think it is started from the point at which they have a complete application. Review your application VERY carefully before sending it. Learn from my mistake. I hope you find this post helpful... Richard Oh, BTW, the C & R application is only a Federal requirement. You must also comply with any state requirements as well; with luck, you may live in a state that has no requirements beyond the Federal ones. Last edited by siegersallee; 06-09-2012 at 05:21 PM. |

C & R arrived!!!
Hi all,
Well, after the initial hurdles, all is well. In fact, I must give credit where it is due. When the omission was corrected, the application was entered into the system on 9 June and approved on 27 June and I received it on 2 July! Actually, that is not bad. So I am legal! Richard

Long guns do not require any paperwork unless you're buying from a dealer, who will do the background check. Private, undocumented sale of rifles and shotguns is OK. Guess it was a choice between states' rights and ours, and we lost. Most other states don't make it so tough, except maybe Mass. and Kalif. David Parker |

With C&R license, C&R guns are OK in Mass. But they successfully turned gun right off, and replaced that with a plastic "Permit" card. Modern rifle fans suffer in Mass. though, the 1994 "AWB" does not sunset in this state.
California situation is worse. |
