Default Artillery Acquisition Q

OK, can someone bring me up to speed on Artillerys? specifically, Artillery Lugers and shoulder stocks?

SBRs under the NFA34? Or because they are C&R, they don't require the $200 tax, form and wait?

Are repro stock OK, or not, or is that still a "maybe" area?

BATFE rules that Artillery Lugers with original manufactured, and appropriate, stocks are 100% exempt from NFA '34 restrictions. (I.E., a military stock for a military Arty, a Navy Stock for a Navy Luger, and appropriate commercial stocks for commercial artys/navies/other Commercial variants as listed on BATFE website.) So you cannot slap a navy stock to an arty Luger or it is an SBR needing the $200 tax stamp and paperwork.

Several members here present letters from the BATFE regarding this question that show "close"/"faithful" reproduction stocks are also okay as the guns in question are "primarily collector's items unlikely to be used in a crime." Its a bit of a gray area with repros, and its not codified in the BATFE official document like the original stocks are. So the above letters could be theoretically overruled on a whim by the agent you ask this time and it wouldn't take much from a legal standpoint to uphold that decision. Best of luck!

I remember I've got an inside source for ATF info, now that you've reminded me. So I'll ask and see if I can get a clarification. if I do, I'll pass it on.

Doesn't get much clearer than this 1981 letter to Odin regarding reproduction luger and High Power stocks.

Bottom line is they are OK.

Got word back from my inside source, and the ATF letter is still valid. (It is 38 years old, after all.)

Sigh.

That means I'll be keeping an eye out for an Artillery I can afford.

I have posted the above letter numerous times and at least once a year, sometimes three, folks will tell me that ONLY original stocks may be used.

An ATF agent is unlikely to ask for proof at a range - and I have never, ever heard of it happening, just the fear of it may happen (SBR).

oh well.....
