FFL thread question

Ted posted a message some time ago re FFL. It's an older thread so I decided to post this as a new question. Although I have already added to the old thread, I doubt anyone will go back there to review it, so.....here goes


For the benefit of this Canadian, I would appreciate some background on the FFL, what it provides and why it is needed. I'm not knowledgeable on U.S. laws, etc. As an example, if I was to come down to the states with a P.08 for sale, I would be required by Canadian law to have a "Transport" and "Export" permit. Upon entering the states, if I wished to sell, can I only deal with licensed Dealers(FFL) or can I sell directly to a citizen?

If I can sell to a citizen, or a Dealer, what documentation is required for both situations.

I will defer to people that deal with export/imports I do only in state repairs. Simpson LTD deals with guns from other countrys! Maybe someone else will know!

The P08 in question would have to be imported by a licensed importer. If it is a Commercial Model Luger, it can be imported by an 01 FFL or a holder of a Curio & Relic FFL.These FFL holders are allowed occasional imports, but all the paperwork has to filed with the ATF; serial number,type of pistol etc.. AND it has to meet the point system(as do all pistols that are imported. This is why we can't have all of the nice little pocket pistols imported here anymore. They have to meet certain safety standards, overall length, weight etc, etc. Witness the Walther PPK

that is made outside of the USA. It doesn't meet the standards set up in the Gun Control Act of 1968. We all know that this is not a "cheap" pistol.


Back to the P08, if it is a Military model only an importer of military weapons could import it. There is an importers license that you have to have to do this. And on top of that, it has to have a 5 year provenance that can be proved before it can be brought in.


I'm writing this from memory so if I have misstated anything hopefully someone will correct me.(It is true that memory is the first thing to go)

First let me thank all those who have replied on this item and go on to say.


So...Correct me if I'm wrong on this...


A qualified importer in the U.S. must import. But is there any specifics on how this importation must be undertaken. In otherwords the means of conveyance from Canada to the U.S.. Can I transport to the authorized importer, and if so, what U.S. papers would I need to carry or obtain.

I am presently in the process of importing a FN 24/30 trainer from Canada. I am CR licensed. I had to retain a

licensed importer and provide him with my license and personal information. I then had to pay for the rifle. and the dealer in Canada then had to send an information package to the importer. The importer has to send an application to import the rifle to the ATF for approval. When the importer has the approval form in hand and approved He will notify the Canadian dealer. The dealer will then be able to deliver the rifle to the importer for shipment to me.


Bringing a weapon into the US, I believe you will have to have reason and sign an agreement not to sell it while you in the U.S. and upon leaving the U.S will have to have show the weapon. My two cents. David.
