I have a 30 cal, 1923 Commercial that when I pull the toggle back the action will not stay open. The gun still cocks, but won't stay locked open. Is this unusual?

If it has a hold open device, and most do, it will only stay open if an empty magazine is fully inserted. Otherwise, the hold open may be missing, broken or never installed (on a few Lugers).

Or there is something malfunctioning in the magazine which is not pushing the hold-open up. If you take the top off you can examine (or photograph) the hold-open which is on the right side of the mag. well on top of the receiver.
