Shoulder stocks and broomhandles

Hello,


This is off the subject of lugers but,I have a question about shoulder stocks. I know the general rule is no shoulder stock on a handgun and this includes short barrel lugers. But, does this law apply to broomhandle mausers? I would like to read the law if someone could tell me where to find it on the ATF website. Thanks. Great website!

On the ATF website look under C&R classifications, it should show which broomhandles are exempted by age or other reason from the NFA rules concerning stocked pistols... Yours FGR

Mauser C96 "Broomhandles", Browning and Inglis P-35 "High Power" pistols, and Navy and Artillery Lugers are exempted from the National Firearms Act section on short barreled rifles when accompanied by an "...original, German mfd., ... detachable wooden shoulder stocks...".

Additionally, ATF "...has previously determined that an 1896 Mauser pistol with a reproduction holster/stock that closely approximates or duplicates the original holster/stock, is excluded from the provisions of the National Firearms Act."


This last is not in the ATF regs at the above site, but is covered in two ATF letters (one for C96's and one for High Powers and Lugers). I have copies of those letters and will be happy to share copies with anyone interested - just e-mail me off line.

These regs apply to original guns. Modern production and reproductions, including commeratives (such as the commerative navy made by Mauser in the 60's and 70's) are not exempt from the NFA rules and require tax stamps etc to be legal. At least that is my understanding and I have been trying for the last two weeks to have the Technical Department at the local ATF office confirm this and clearify this in regards to the mauser commeratives. (and I still don't have an answer) But if anyone is considering "making" a navy or the like, make sure you are using period frames at the very least... particularly if you intend to attach a stock.

Ideal stocked lugers are also exempt.

Absolutely! I wanted to make up a reproduction C96 carbine, and ATF was adamant that such a reproduction was *not* exempt from the NFA; and that attaching any kind of stock to it would create a short barreled rifle under the provisions of the NFA.


Original pistols only - no reproductions :-(
