They must meet that 26.5" requirement. There is no problem meeting this requirement for M-1 Carbines and AR-15 rifles... because the folded length is greater than 26.5"
Some of the shorter barrel AR's do fall under SBR requirements. You have to be careful, just because you can assemble something neat from readily available parts doesn't mean that possession of the complete set of the parts or the assembled item will be legal.
To create or manufacture one of these shortened versions, you must first pay the $200 tax and get approval to do so from ATF. If you do it after the fact, you have violated the law.
Know the law to stay out of trouble, and if you don't know the law yourself...get answers from someone who does.
