Hello Tracy,
1. You are correct about not needing to wait the 10-days for any C&R pistol. But most local dealers that I buy lugers from do insist that I have the HSC. I think they do that to limit their liability incase I bring the C&R home and shoot myself in the foot or worse, a family member. By their insisting I have the HSC, they can atleast know I am not an idiot, gun-wise...
I do buy other pistols that are not yet on the C&R list, so I do run into the 10-day wait and 1 pistol per month issue. But you are right; I can buy as many C&R's in one month as I desire and do not need to do the 10-day wait.
2. I may still disagree with you on the point of whether C&R's need to be registered. Here is the text from the DOJ web site :
" Effective January 1, 1998, any person who moves into California and who brings any pistol, revolver, or other firearm capable of being concealed upon the person is considered to be a "Personal Handgun Importer" and is required to do one of the following within 60 days:
Complete and submit a Report of Handgun Ownership form along with $14.00 to the Department of Justice. A separate report form and $14.00 fee is required for each handgun reported. Report of Handgun Ownership forms can be obtained from California Department of Motor Vehicles' offices, licensed firearms dealers, local police and sheriff's departments, the California Department of Justice Firearms Division at (916) 227-3703, and from the Online Forms Page at this site.
Sell or transfer the handgun(s) to a California licensed firearms dealer or to another individual using a California licensed firearms dealer to conduct the transaction.
or
Sell or transfer the handgun(s) to a California police or sheriff's department. Persons choosing this option should contact the law enforcement agency for instructions prior to transporting the handgun(s) to the agency.
Any person transporting handguns in California is required under California law to transport those handguns unloaded and in a locked container other than the glove compartment or utility compartment of a vehicle.
Please be aware that failure to comply with these mandated handgun requirements could result in criminal prosecution (Penal Code Section 12072(g)). "
This registration statute only states if the gun can be concealed on a person, it must be registered. If does not mention any exemption based on how old the pistol is...
This info. was from the DOJ wed site at :
http://caag.state.ca.us/firearms/ab991.htm
3. If you moved into CA-State after 1-1-98, you need to register all handguns. I was also advised, by a decent laywer friend, that if I buy C&R's out-of-state and bring them in, I need to register them. Since I am acting as a "personal handgun importer".
You might want to research this issue in more detail. You might have some C&R that the State might need to know about...
4. For any C&R's I find in CA-State, private party sales are not longer allowed, even between two C&R holders that both live in CA-State. Such a pistol sale would need to go through a Type 01 FFL dealer who does all the registration paperwork at point-of sale/transfer; so the pistol is still registered with the State and the BATF.
Sort of got you coming & going...
Best Regards,
Pete... <img border="0" alt="[typing]" title="" src="graemlins/yltype.gif" />
