I have at least two others that do the same thing; but didn't notice it with that one. I just push it back in place when I notice it slips up.
Send her back if you wish, not a problem. I don't remember there being any problem with the teeth or wear, the bbl is virtually new.
Jerry's, solution of use a small tie wrap will work, but not very elegant.
I'd try a stronger spring if it were here, or some "loctite" in the lower position(of course that would make the "adjustment" difficult).
