When does a Luger Stock make it an SBR?
 
Hello, from what I have gathered while looking through these forum archives, after 2004, all matching Lugers and their stocks (needed to be matching or otherwise period correct) were moved from class III SBR designation to the c&r designation under the BATF guidelines. Would a mismtached shooter luger with stock or luger with mismatched stock also fall into the same category of c&r or would it be considered an SBR with a class III license necessary?

It ALL depends on classification, navy HAS to go to a navy stock
An Artillery HAS to go to a artillery stock
Carbine with carbine

a few exceptions, but it is spelled out in the C&R exceptions listing.

Matching numbers is not an issue.
As Ed said, what is important is that the stock and pistol are of the same "type" and that the stock is original or a close copy of the original.

For what it's worth, Title II status (i.e., NFA-controlled items - what you're calling "class III") and C&R status are not mutually exclusive. C&R status does not negate the NFA; plenty of NFA stuff is also classified as C&R.

So if, for whatever reason, I managed to attain a stock of some type and managed to then attach it to a commercial model luger, would that be allowed or disallowed by these guidelines? Or are you all basically saying I would need to find a commercial style stock either repro or original? Note: I dont have a stock, I just dont want to get one and unintentionally land myself in hot water.

A Commercial Luger is out, unless it's a Commercial Navy or a Commercial Artillery.

An Ideal holster stock on a 1900 or 1906 commercial or American Eagle Luger is also a proper combination.

There are exceptions - don't guess, google ATF regulation 5300.11

A few years back the Finnish Luger was placed on there, 4 inch, 7.65mm or 9mm and a stock. Pretty open interpretation....

Close but not quite :) According to BATFE the Ideal holster stock is only legal on 1900, 1902 or 1906 American Eagle Lugers...a standard commercial model is not permitted. It seems like splitting hairs, but whoever applied for the exemption of the Ideal holster stock specified only AE Lugers, so that is what is in the rules.

The rules don't make particular sense, and unfortunately they don't have to.

Note that it may be considered "constructive possession" to have an attachable stock, have an incorrect Luger (one that was not released to go with that specific stock type) and not have the correct Luger that it goes with.

These kind of things may not be actively enforced, but you're exposed should you ever have an incident that leads to investigation or to a change in government leadership that leads to aggressive enforcement actions.
