Wjat is an Assault Rifle?
 
I remember reading a thread here about a guy correcting Mr. Tinker on a M-1 carbine not being an assault rifle. I do remember at one time I read the Germans calling it that. I looked all over the internet to find proof of this to back Ed up, I found nothing.

Today watching Great Tank Battles, there was a German talking about a battle where he makes reference to a guy getting out of his Sherman with his assault rifle....A M-1 carbine. I looked all over for that thread on here to add to it this dialogue but I could not find it. The Germans did call an M-1 an assault rifle.

The 1994 US law that implemented a "Federal Assault Weapons Ban" gave it a try. By that legal definition the wooden stocked M1 Carbine would not be considered an assault weapon. By that definition, the firearm had to have two cosmetic features:
Semi-automatic rifles able to accept detachable magazines and two or more of the following:
The M1 Carbine only has one of these cosmetic features, the bayonet mount.

The M1A Carbine (para-trooper model) did conform to the definition, because it had a folding stock and bayonet mount. Thus the magazine that fits either firearm could be associated with an "assault weapon", and Ebay's position conforms to their rules.

Interestingly, the M1 Garand battle rifle did not conform to the definition because it did not have a detachable magazine. It used an enblock clip internal to the receiver.

The 1994 law has expired. Whether that legal definition still stands would be an issue for the courts.

This US law was completely irrational, and accomplished nothing except to interfere with law abiding citizens and their constitutional rights. We have other irrational laws; some of them quite old. For example, Noise suppression of firearms is controlled under the same laws that define and control fully automatic firearms. A very expensive transfer tax and extensive background checks are involved in purchase. In Norway (a more rational approach) encourages the use of noise suppressors to avoid disturbing neighbors when you're hunting and practicing target shooting.

In the popular press in the USA, anything that looks "evil" and shoots is called an "assault weapon". For that reason, the common person unfamiliar with firearms and vulnerable to emotional manipulation by the press thinks of most firearms as "assault weapons". I expect that many would consider Lugers to be "assault weapons".

In CA the gunners had to make a flow chart to determine if a gun was considered an assault rifle and would be illegal to own with out prior registration (http://www.calguns.net/caawid/flowchart.pdf). The chart worked so well that the police carry them and often refer to the chart when checking guns. The news seem to use the theory that if it is not a single shot it is an assault weapon.

This whole discussion can go circular chasing it's tail..Of course the M-1 Carbine is an assault rifle! So is a .22 bolt action if you assault with it!

An M1 carbine is NOT an assault rifle. An M2 carbine (select fire) would possible fit the definition.

It's become necessary to add a caveat when using the the term "Assault Rifle" (eg "'assault rifle' as defined by x,y, or z").

Padre, Ebay is confusing, but they have an outright ban on any magazine holding more than 10 rounds. It's not necessarily because the mag is "assault rifle" related. Here is a link to Ebay's firearms and weapons rules:

fully aware of that, they did not remove the ad because of magazine capacity it was becuase of them placing the m1 carbine on the assault weapons list. But they do operate as a california company and follow ca, rules. but you are correct about their ten shot capacity rule.
