New Law?
 

My long time trading buddy called me today and said he heard at the local pawn shop that a law (Federal?) went into effect on the first of January. If you as an individual sell a firearm to another individual without getting a police & federal check and the person is not elgible to own the firearm and uses it illegally you are held responsible. Here in Alabama you can marry your first cousin, fourteen is the age of consent, prostitution is legal outside of city limits, I have read in the paper of two instances of guys arrested for having "relations" with animals,(Arab Tribune) but this is illegal. I avarage two-four guns a month trading or selling. What have ya'll heard?

Hi Grady! Making law's is one thing! Making them stick is a whole nother animal! I don't think they can even make that law work in CA! BTW, Alabama need's some work, if what you say is fact! till...later...G.T.

There is nothing on the BATF webpage that I can see. Probably a new rule for dealers, but I don't think for civilians, as it would be prominently displaye


Also, nothing in their December newsletter, and it would be there if it was for January.

Its fact. The good part about living in Alabama is you can do what you want. The bad part is you can do what you want.

All references have been in newspapers. Keep your ears open about the law. I'll call the pawnshop tomorrow and get the details on the law.

Most states allow its residents to transfer firearms between private individuals that they know to be of GOOD CHARACTER. So if you sell a firearm to someone you don't know well, and they turn out to have a felony conviction or are otherwise prohibited, you are violating laws already on the books. Tom h

I haven't seen anything like that in the newsletters. I don't think that BATF even addresses sales between non-liscensed individuals. Probably a state law, apparently the individual states have quite a bit of leeway in applying the federal laws. Here in Utah, if you have a concealed weapons permit, there is no waiting period, walk in, buy it, walk out with it, the Brady law doesn't apply. Would appreciate hearing the final findings on this though just in case I missed something.

There was something similar to this in the "gunshow" amendment added to the recent finance bill passed by Congress. It was removed before the bill was voted on.


There is no federal law to this effect, however given the present climate of antigun organisations & cities bringing suits against manuf and retailers of firearms, I would not be surprised to see them start to sight in on private individuals. This may be a new state law, but to my knowledge, it is not a federal one.

I called the pawnshop today and got the answer that in the reprocity (? spelling) act between states reference concealed carry permits - this is added. It is state, my buddy at the shop will get a copy of it and let me know tomorrow. G.T- The R is for Randall but roadkill works fine. I was run over by a Humvee last year and the name stuck.

Damn!! You were lucky to survive! They (Humvees)don't look too light to me! That,s the same kind of luck I have....It's kinda like God striking you with a glancing blow, instead of a direct hit! Hope your luck gets better, or at least continues! Roadkill it will be then!....till...later...G.T.

Herb, I really don't want to take the wind out of your sails, but in Utah (I live there, too) holders of concealed firearms permits are subject to the dealer calling to get a state clearance for the purchase. The dealer must complete a "Firearms Transaction Record", Form of the Utah State Bureau of Criminal Investigation. This form contains a Search Request Nunber assigned by the BCI of Utah. Pink copy goes to BCI, Seller keeps white copy, local law enforcement agency may (in italics) receive the yellow copy.True, we don't have to go through the Brady Law hoop, but it isn't a walk in -- walk out deal, either.
