Can non C&R send Luger USPS Priority?
Is there any consensus as to whether a non licencee (no C&R and no FFL) can send a Luger thru USPS Priority to a C&R or FFL holder? Seems pretty murky to me.

In theory, no. Pre-1899 antique is OK under current regulation.

Only an FFL holder can ship a handgun to an FFL holder via USPS, FFL to FFL ONLY . It's a Postal Regulation that conflicts with BATF Regulations. Long guns are not subject to this regulation and may be shipped by a private indiviual to an FFL holder only.

Ron forgot to mention that he is a retired postal worker... so I would lend a lot of credence to his advice...
You CAN send a C&R to a C&R holder if you have a signed copy of his license and you send it OVERNIGHT via FEDEX... not the USPS. |
On package label, it's best *not* putting any word associated with "gun". Some FFLs were issued to the businesses with names like "ABC Gunsmith" or "XYZ Pawn Store of Jewelry and Guns"...... no, no :nono: By package of this size, this weight, destinated to this address, what can be in the box...... those things have resale value so very easy to get lost in transportation. Plain label, package well, and shipping via Fedex or UPS should work.

I would add that there has been extensive debate as to whether a C&R is considered an FFL. And if a C&R is allowable for shipping through USPS. It is, it's an FFL 03. The regulations state FFL Dealer to FFL Dealer. However the term Dealer is ancillary and was used in conjuction with FFL when the regs were written.
I have talked with 3 or 4 Postal Inspectors concerning the translation. One said he wasn't sure. The others all said that an FFL is an FFL, that the regs were meant to pertain to a "licensed person as opposed to a non-licensed person.
