Is the Stoeger .22 “Luger” C&R eligible?
 

As the title suggests, I’m wondering if the 1970’s era Stoeger .22 is C&R FFL eligible. I actually bought it with mine many years ago, but now that I’m selling mine I want to make 100% sure. I checked the ATF list but it only raised more questions than it answered.

Anyone know for sure?

A quote from the BATF web site: "Firearms manufactured at least 50 years prior the current date, but not including replicas thereof;"

All well and good, but they make all kinds of exceptions to that rule. Like, a million of them. My question arises from this statement on that same list.

“Luger, Mauser Parabellum, semiautomatic pistol, cal.’s 7.65mm or 9mm Luger, 4” and 6” barrel, Swiss pattern with grip safety and the American Eagle stamped on the receiver; made from 1970 to 1978.”

I think this applies but I’m not 100% sure.

Never mind, that can’t apply because of the lack of grip safety and caliber….

I think the 50 year rule applies to a Stoeger Luger as much as any other firearm. Since it is a Luger in copyrighted name only, lists of variations of original Lugers would not apply. Anything made before 1972 at this point would qualify as a C&R, so you may have to wait a few years before a Stoeger Luger would qualify. Some of Erma's earlier model toggle pistols have phased into C&R status, but there are perhaps 20 years to wait before the later models follow suit.

If the individual firearm was manufactured 50 years or more ago, it is considered C&R. The list is for additional firearms that may be newer. So, if it was made before 1972, it's C&R. You would need to be able to determine that by serial number.

This means that post war HSc pistols are also C&R provided the manufacturing date is pre-72? That includes the majority of post war production.
